NCMA membership terms and conditions
Applications for membership
NCMA welcomes applications from all home-based
child carers who are aged 18 years or over and from Local Authority
"Quality Partners".
You can apply for NCMA membership in the following ways:
- Joining NCMA
online with a credit or debit card
- Completing and sending back the NCMA application
form
- Calling our Customer Services team on 0845 880 0044 between
8:30am – 5:00pm, Monday to Friday (except for bank holidays).
Membership is valid for 12 months.

Registration with your regulatory body
As an NCMA member you are required to hold and
retain a valid registration with your regulatory body (Ofsted,
CSSIW or CAS). The only exception to this is if you hold Local
Authority "Quality Partner" membership.
If you are undergoing registration, you have
90 days from the day your membership begins in which to provide us
with your registration number. Failure to provide a valid
registration number within 90 days of the start of your membership
will result in your membership and Public Liability Insurance being
cancelled without refund.
Your NCMA membership and Public Liability
Insurance will be automatically cancelled and invalidated (without
refund) if your regulatory body suspends or de-registers you or if
you fail to renew your registration.
Membership renewals
We will contact you before your membership is due for renewal,
detailing the expiry date of your current membership and the
subscription due.
If your membership subscriptions are paid by Direct Debit, we
will automatically renew your membership after 12 months and
collect the monies for the coming subscription period unless you
notify us that you do not wish to renew your membership within
three working days of your renewal date.
Change in personal details
If any of your personal details change (e.g. name or address),
please inform us by updating your details in MyNCMA or by calling us
on 0845 880 0044 You must also inform us immediately if your
regulatory body suspends or de-registers you, or you fail to renew
your registration.
Our responsibilities to you:
NCMA will use your information to:
- Provide the products and services you need
- Improve the quality of our products and services to you;
and
- Provide you with offers that we believe will interest you.
We may pass your details onto our subsidiaries including NCMA
Services Ltd.
We would like to tell you by post, telephone and email about a wide
range of offers, which may interest you. If you do not wish to
receive this information please call the Customer Services team on
0845 880 0044 or inform us when you join/tick the relevant boxes on
the application form. You can manage your preferences in the
My details section of
MyNCMA.
We may monitor or record telephone calls and or emails for security
reasons and to improve the quality of our service to you.
When you contact us we will ask you to register security
information to help protect your account. If you choose not to
register this information you will not be able to manage your
account over the phone or online. You must not share, disclose or
publish your security information or NCMA membership details with
others and if you do so, we reserve the right to cancel your
membership (without refund of your membership fee).
Please note that we will disclose personal information to fraud
prevention and other agencies to help prevent crime or where we
suspect fraud.
You have a right to receive a copy of the personal data that we
hold about you. There will be a charge of £10 towards the cost of
administration. To obtain a copy of the personal information
we hold on you, please write to the address below or alternatively
ring Customer Services on 0845 880 0044 to request this. A cheque
for £10.00 made payable to NCMA is required as payment.
How to cancel your membership
If you change your mind within seven working days of
receiving your membership pack, we will give you a full refund of
the price paid for your membership, provided;
- you write to us at NCMA, Royal Court, 81 Tweedy Road,
Bromley, Kent BR1 1TG or telephone us on 0845 880 0044 requesting
cancellation of your membership; and
- you return your full membership pack to NCMA within seven
working days (beginning on the day after you receive your pack).
Please note that you will be responsible for the cost of returning
your membership pack to NCMA.
If we cancel your membership
We value your membership, however, we reserve the right to
cancel your membership if you do not adhere to NCMA’s quality
standards, your regulatory body’s practice guidelines (Ofsted,
CSSIW or CAS) or bring NCMA into disrepute. Failure to provide
payment when due may also result in cancellation of your
membership.
There may be other circumstances where we believe it is
inappropriate for a child-care member or Quality Partner to remain
a member. We reserve the right to cancel membership in such
circumstances, although we will always communicate the reasons to
the member and provide them with the opportunity to discuss this
with us before taking a final decision.
Copyright
Except as is otherwise indicated, we and/or
our licensors are the owners of the copyright (and all related
intellectual property rights, including but not limited to all
database rights, unregistered and registered trade marks, service
marks and logos) in all the membership materials.
You shall not, except with our express prior
written permission, distribute, publish or commercially
exploit part or all of NCMA’s materials.
You may print or download member materials for
your personal and non-commercial use only, providing no
modifications are made and the document is copied entirely and NCMA
is acknowledged as the source of the material.
Trade mark
NCMA’s trade marks, logos and service marks (collectively
the “Trade Marks”) are and shall remain the property of their
respective owners. Nothing shall be construed as us granting any
licence or right to use any Trade Mark without the written
permission of the relevant Trade Mark owner.
Your misuse or infringement of any of the Trade Marks is
strictly prohibited and we reserve the right to cancel your
membership if you do not adhere to NCMA’s brand guidelines.
Current NCMA childcarer members are able to
use a "Member of NCMA" or "Member of NCMA Cymru" logo.
Only the “Member of NCMA” logo may be used by
childcarer members and, in all cases, the logo must:
- only be printed in black and white or in the
NCMA colours
- not be altered in any way or have items added
to it
- not be used in a way that would bring NCMA or
childminding into disrepute or in a way that implies NCMA
endorsement or approval of a product or service
- only be used for not-for-profit
activities
- not be used to reproduce NCMA publications or
products
- not be used if their NCMA membership
ends
- only be used by childcare members.
For members operating in Wales, there is the
option for using the NCMA Cymru logo.
Members can obtain a copy of the member logo in MyNCMA
or by emailing info@ncma.org.uk, providing proof of
membership and confirmation that they are using NCMA contracts.

General
Any dispute arising out of these terms and conditions are
subject to the laws of England and Wales and is subject to the
exclusive jurisdiction of the English Courts.
We may make improvements or changes to the membership products,
services and/or materials and/or terminate/suspend the membership
products, services and/or materials at any time, without notice.
Upon your acceptance of membership, you agree to be bound by any
terms and conditions relating to membership benefits (including
products, services and member factsheets).
We may also amend these terms and conditions from time to time.
If we make any substantial changes we will notify you by posting a
notice on this page of the NCMA website. You are bound by any
changes we make to these terms and conditions.
The headings in these terms and conditions are for convenience
only and shall not affect the meanings of these terms and
conditions.
If any provision of these terms and conditions is unenforceable,
it shall not affect the enforceability of the rest of them.
NCMA shall
not be liable, whether in contract, tort (including negligence),
breach of statutory duty, or otherwise, for any loss of profit, or
any indirect or consequential loss arising under or in connection
with your membership. NCMA’s total liability in respect of all
other losses arising under or in connection with your membership,
whether in contract, tort (including negligence), breach of
statutory duty, or otherwise, shall not exceed the purchase price
of your membership.
Nothing in these terms and conditions shall limit or exclude
NCMA’s liability for:
(a) death or personal injury caused by its negligence, or the
negligence of its employees, agents or subcontractors (as
applicable);
(b) fraud or fraudulent misrepresentation; or
(c) breach of the terms implied by section 12 of the Sale of
Goods Act 1979; or
(d) defective products under the Consumer
Protection Act 1987
